Unfair terms (Articles 1341-1342 of the Italian Civil Code)

FOR EXPRESS APPROVAL

Pursuant to Articles 1341 and 1342 of the Italian Civil Code, the parties expressly approve the following articles of the Terms and Conditions of Use of the Platform (version 1.0):

• art. 2 — Status as intermediary and exclusion of liability for the performance of services between Users;
• art. 8 — Duration and Withdrawal;
• art. 16 — Right to suspend, limit and discontinue the service;
• art. 17 — Intermediation fee - Account Suspension;
• art. 18 — Payment handling through an external provider;
• art. 19 — Order and payment handling - Provider's loss of the right to remuneration - Time bar on objections;
• art. 20 — Causal link and traceability;
• art. 22 — Limitation of the Platform's liability;
• art. 23 — User's liability;
• art. 24 — Users' freedom of contract;
• art. 27 — Intellectual property;
• art. 28 — Amendments to the Terms and Conditions;
• art. 30 — Place of jurisdiction.

Specific approval is given electronically on the Platform by ticking the dedicated box during registration, separate from the box accepting the Terms and Conditions; the Platform records the version of the text, its digital fingerprint, the account and the exact time of approval.
